Custodia Bank Vs. The Fed

The legal battle between Custodia Bank and the Federal Reserve has emerged as one of the most consequential financial cases of the decade. At its core, the dispute centers on whether or not regional Federal Reserve Banks have discretion to deny a state-chartered institution access to payment rails. This case strikes at the heart of the dual banking system and the regulatory boundaries of central banking.


Custodia Bank was founded in Wyoming by Caitlin Long, and created with that was the Special Purpose Depository Institution. The state of Wyoming created the SPDI charter specifically to bridge the gap between traditional banking and the economy of digital assets by requiring the institutions to maintain 100% fiat reserves for digital asset custody. In October of 2020, Custodia applied for a Federal Reserve master account, which is the holy grail that allows direct access to central bank payment systems. Initially, the Kansas City Fed viewed Custodia as legally eligible, but then the application stalled and in January of 2023 they were denied.


Custodia deems that this is an unlawful rejection, the they have served the Federal Reserve a multilayered lawsuit that includes statutory authority, risk management clauses, and administrative review. The district court ruled in favor of the Federal Reserve, concluding that the Kansas City Fed maintained discretion over the master account and who they granted it to. Then, in the tenth circuit it was a much tighter race. They still ended up favoring in the Feds hands though, because they want the Federal Reserve to have control over account applications.


Custodia is now trying to get the case to the Supreme Court by petitioning the Tenth Circuit's decision. This has gained a lot of traction, and traditional banks are siding with the Fed while digital asset advocates are helping out Custodia.
